Tomorrow the Altai Arbitration will continue to consider the claim of the Prosecutor General’s Office against OJSC Kuchuksulfat. The entire Russian business community is watching the events. The result of the society’s request was press conferences at Interfaxto which the chairman of the board of directors of the enterprise was invited Vasily Gamayunova and head of the legal department Irina Volodina. At a meeting with journalists, facts were made public about the plant’s impressive financial losses against the backdrop of unlawful 4-year pressure, which unexpectedly ended in a privatization trial.
Main points of the press conference:
-The situation with the plant is a reprisal against a successful, socially responsible enterprise and its owners;
-The privatization of Kuchuksulfate began under the USSR in 1991 as a rental enterprise. It lost its status as a state-owned enterprise upon concluding a lease agreement with the right to buy. Government consent was not required for this;
-There are several documents in the state archive, as well as several inspections by the prosecutor’s office, indicating the legality of the privatization of the plant, which eliminates questions about the illegality of this process;
-The situation with the plant threatens the safety of all Russian business. It proves: the legal status of property in the country is unstable even after 30 years of ownership;
-Due to threats of physical harm, a criminal case was initiated, and Vasily Gamayunov was taken under state protection. The names of those making threats have not yet been announced due to the secrecy of the investigation. On the facts of illegal 4-year raider pressure against Kuchuksulfat, an application was filed addressed to A.I. Bastrykina;
-Withdrawing money to offshore companies is a lie to disguise a raider takeover as a fight against the withdrawal of capital;
-Kuchuksulfat has no assets abroad, and its shareholders do not have palaces, yachts, planes or bank accounts abroad;
-The company “Kapok”, based in Cyprus, which the interested parties pass off as a shell company for withdrawing money to an offshore organization that manages the shares of Barnaul resident Veniamin Kur (individual). The businessman went to Cyprus in 1999 and legally transferred his 15% stake to the company;
It made no less noise Vasily Gamayunov’s speech in court. The prosecutor objected, but the judge gave the floor to the businessman, who has been fighting for the assets of shareholders and for the life of the factory village for the 5th year now. V. Gamayunov said: in the late 90s, the plant was on the verge of bankruptcy when it was bought out from the primary shareholders. There was barely enough money for a salary: they worked 3 days a week. Now the plant is the most striking example of achieving privatization goals in the region, a developing enterprise with a number of social programs and the highest salary in the region. Apparently, this is why Kuchuksulfate fell into the sphere of private interests conducting business in an uncivilized manner. When asked by the lawyers which plant the prosecutor’s office wants to take away from the shareholders – the one from the 90s (almost bankrupt) worth 400 million or the current one worth 17 billion, the prosecutor publicly stated: the plaintiffs are interested in 100% of the shares of the current plant. Oh really?! The plaintiffs claim that the state did not know for 30 years that the plant had been taken away from it. But “no one was hiding from the state,” V. Gamayunov retorted in court: taxes were paid, workers were rewarded at the regional and national level, the plant was written about in the press as a joint-stock company. According to the prosecutor, questions about the legality of privatization arose due to publications in the media. But in dozens of slanderous materials in low-quality publications there were no reports that Kuchuksulfate was privatized illegally. Then a fair question arises: why did they take on the plant now, after inspections and 4 years of pressure? Budgetary support for socio-economic activities is also becoming more difficult in the single-industry town of Kuchuksulfat – Stepnoe Lake (there is no longer any drinking water in the city). The union held 5 rallies, 4,000 people signed an appeal to the president, but all defenders of the enterprise are under pressure. The local head, Olga Vorobyova, came under pressure. She received 11 prosecutorial requests when she told the truth at a rally where they signed an appeal to the president. And the deputies of the Blagoveshchensk district, who voted at the session for an appeal to V. Putin, became the objects of an anti-corruption audit. They were interrogated regarding their income statements.

“The dynamically developing enterprise “Kuchuksulfat”, whose value is estimated at 17 billion rubles, is being subjected to a “hostile takeover” attempt.
