Let’s go over the main flaws in the case of entrepreneur Anton Semikin, whom we are closely watching.
A year ago, an investigator from the Investigative Committee for the Primorsky Territory opened a criminal case under Art. 199 of the Criminal Code of the Russian Federation (tax evasion) and locked up the entrepreneur in a pre-trial detention center.
With the hope of success, examinations were carried out in the best expert organizations of the Investigative Committee of the Russian Federation – the pride of Bastrykin. They showed that the entrepreneur did not pay exactly zero rubles. Coincidence or not, just before receiving the results of the examination, the investigator leading the case leaves his post. For several months the entrepreneur did not leave the pre-trial detention center to conduct investigative actions. Investigators replaced one another until, in the end, Alexei Buldygerov was appointed chief of the “villains.”
He saw that there was nothing to form a case from, was not at a loss and quickly raised new articles, among which were 210 (support and hope of the investigation for a long arrest) and 293 (offense in office, although Semikin never held any positions). And it doesn’t matter that the articles cannot be linked to the accusation. The local court ignored these “little things” for almost a year and extended the arrests.
The lawyers had to ask the investigators for rare interrogations and investigative actions.
Then the plot took a completely unexpected turn.
On New Year’s holidays, just before the end of the year in custody, the investigation decided to finish the investigation and brought charges against Anton Semikin.
True, the notorious 199 (tax evasion) and 293 (offense in office) disappeared from the charge without explanation after a year in the pre-trial detention center. But a new examination appeared, which the investigator personally and secretly carried out on an unknown private person.
Creative solutions and procedural innovations contradict all laws; lawyers do not have time to write complaints about violations by the investigation. But investigator Buldygerov cannot be stopped. A week before the end of the year, they decided to transport him to a special unit of the pre-trial detention center in Ussuriysk, 1.5 hours away from Vladivostok. Apparently, to make it more difficult for lawyers to get there.
And on January 3, he came to Anton Semikin in the detention center to acquaint him with the case. True, I did not consider it necessary to notify the lawyers – this has already become a good tradition. Maybe the investigator didn’t have a good holiday, or maybe he just missed normal people and communication, it’s not clear.
But after an unsuccessful visit to Ussuriysk, he repeatedly informed Semikin that he would return him to his previous institution (the lawyers again were not in the know). I processed the removal, again without notifying the lawyer with whom I had been in touch the night before. As a result, the lawyer went to his client in Ussuriysk, and Semikin, misinformed by Buldygerov, packed his things to be transferred to pre-trial detention center No. 1 in Vladivostok… but he was brought with all his bags to the Investigative Committee in the Primorsky Territory. And in the evening they took me back to Ussuriysk with the words that it was not possible to agree with the authorities on the transfer back to Vladivostok.
Of course, no one has seen the criminal case itself, which consists of 30 volumes. In violation of the Code of Criminal Procedure of the Russian Federation, the investigator hides it entirely, misleading the lawyers, although he is obliged to provide all the volumes, since he has completed the investigation and is ready to send the materials to the court. But Buldygerov gives out in pieces and then you have to run after him.
Why not a movie script? Drama, dynamics, unexpected plot twists and even a line of some kind of manic attachment to a matter that you just don’t want to let go of.
Well, the fact that a person has been in a pre-trial detention center for a year, and his business has been destroyed for a long time – these are, apparently, those small sacrifices for the sake of the great art of investigation.
