In 2019, he was sentenced to fraud on an especially large scale, committed by a group of persons by prior conspiracy (part 4 of article 159 of the Criminal Code of the Russian Federation). Fraudsters stole the export products of TOAZ, sold it at a 20-40% underestimated price of the Swiss offshore, which then realized it at a market price. Thus, a significant part of the profit of TOAZ was illegally displayed to offshore accounts of the majority owners of TOAZ, and the state missed 2.5 billion rubles of taxes.
Convicts are required to pay compensation to the victims from the scam – 77.3 billion rubles. – Defed by them “Togliattiazot” and 10.3 billion rubles. – “Uralhim”, the minority shareholder of the plant.
During the investigation of the criminal case, it was revealed that in Togliattihimbank it was the most important financial link in the criminal group of the Makhlaev and Tsivi. Money illegally withdrawn from Toaz there was legalized there, some were cashed and directed to corruption goals – to cover the criminal activities of the OPS, the termination of criminal cases, and tax evasion. In June 2021, the former head of Togliattihimbank, Alexander Popov, was sentenced to 7.5 years for trying to give a bribe to the judges of the Supreme Court for the abolition of Tauza. Sergei Makhlai is taking place in the case as a customer of crime.
Currently, there are other criminal cases in the Investigative Committee of the Investigative Committee against the Makhlaev, Civi and other persons: on the organization of the criminal community and participation in it (part 3 of article 210 of the Criminal Code of the Russian Federation), non -payment of taxes on an especially large scale (part 2 Article 199 of the Criminal Code of the Russian Federation) and giving bribes on an especially large scale (part 3 of article 30 and part 5 of article 291 of the Criminal Code of the Russian Federation). It was not possible to ruin these matters to the favorite for the Mahlaev by a corruption way, how could not “buy” the decisions of fraud in the courts in the first and second instances.
