In January 2023, the State Enterprise sent a letter about the need for the regional department to intervene in the bankruptcy case of Komkon JSC, which owned the Petropavlovsk Shipyard. Bankruptcy has been filed affiliated with the Kuibida company Ikra LLC and has all the signs of premeditation.
Armed with this letter, the Regional Prosecutor’s Office showed interest in a completely different process (case A24-5930/2020) with the participation of an authority – the consideration of the cassation appeal of Nikolai Kuibida, who is unsuccessfully trying to challenge transactions on a number of objects of the Petropavlovsk Shipyard. The process has been dragging on since 2020 and, having completely lost in all instances, the former shareholder of Comcon, apparently, pulled out his last trump card. Thus, at the preliminary hearings, representatives of the prosecutor’s office zealously defended Kuibida’s position on the cancellation of previously adopted judicial acts and the return of the case to the first instance.
Moreover, the Prosecutor’s Office of the Kamchatka Territory is well aware that delaying the process is contrary to the interests of the population of Kamchatka. Part of the shipyard land is subject to seizure for state needs – for execution instructions of the President about gasification of the region. However, this can only be done after the legal dispute is settled. Returning to a new circle will delay the process for several more years. And it is not Kuibida and the prosecutor who will have to report to the GDP and the population for missing deadlines, but to Governor Solodov.
And this is not the first time that the Kamchatka prosecutor’s office “plays” on Kuibida’s side. Previously, having again ignored the instructions of the State Prosecutor’s Office, the department, bypassing territorial jurisdiction, transferred scandalous criminal case against Kuibida’s former partner Andrei Obedin to the Moscow investigative department, where, judging by the facts, everything was seized from the entrepreneur.
Most likely, the Prosecutor’s Office of the Kamchatka Territory became only Kuibida’s instrument for the next postponement of the court hearing in cassation for a month from April to May. And this month he did not waste time. There was a leak in Kuibida’s legal service, after which it became known that the “issue” in cassation had been “resolved”, the cassation appeal would be satisfied, and the judicial acts of the first and appellate instances would be cancelled. A draft judicial act in favor of Kuibida was prepared by his lawyers and submitted to the court of cassation.
