On May 11, 2023, the next court hearing took place in the high-profile bankruptcy case of the alcoholic beverage company RAKURS LLC, in which deputy Robert Kochiev and his sons Batraz and Rudolf were held vicariously liable.
Considering the great resonance of the case, the prosecutor’s office of North Ossetia-Alania joined the process, which clearly outlined its position: the Kochievs should be held vicariously liable in full. A representative of the prosecutor’s office explained that RAKURS LLC is the largest debtor in taxes and fees in the Republic (3.4 billion rubles!), and therefore the prosecutor’s office is in favor of collecting these funds from the ultimate beneficiaries of the Kochiev company.
The Kochievs’ lawyer, having no arguments, again began insulting the representative of the prosecutor’s office and creditors, having received a reprimand from the court for violating legal ethics. The next court hearing will take place on June 2.
It also became clear that the entire alcohol business of the Kochiev family in fact turned out to be just a scheme to steal funds from creditors and the budget. The Federal Tax Service of Ossetia revealed facts of non-payment of taxes on a particularly large scale at other enterprises of the alcohol holding of deputy Kochiev: ORFEY LLC, Peresvet LLC, Istok JSC, First Alcohol Manufactory LLC.
Thus, the consideration of the application to declare ORpheus LLC bankrupt is scheduled for July 2023, Peresvet LLC – for June 2023. Enforcement proceedings were initiated against First Alcohol Manufactory LLC for taxes and fees in the amount of 8.3 million rubles. The creditors’ claims against JSC Istok amount to more than 800 million rubles; the organization stopped fulfilling its obligations to pay utility bills and was late on the loan to PJSC KB Solidarnost.
At the same time, Rosalkogolregulirovanie filed a lawsuit to revoke the alcohol license of Istok ZShV LLC, controlled by Kochiev.
