The Nizhny Novgorod District Court found guilty the former police officers of the drug control department of the Russian Ministry of Internal Affairs in Nizhny Novgorod. In September 2019, they beat Igor Krainov during his arrest and planted drugs on him. The interests of Igor Krainov are represented in court by lawyers from the Team Against Torture.

Three former senior detectives were found guilty, two of them on several counts. Evgeniy Sokolov and Nikolai Kostrov were convicted of exceeding official authority with the use of violence and causing grave consequences (Article 286, Part 3 of the Criminal Code) and for illegal possession of narcotic drugs on a large scale (Article 228, Part 2 of the Criminal Code). For the incriminated crimes, Sokolov was sentenced to 4 years 6 months, and Kostrov to 5 years in a general regime colony. Alexey Ivanov was found guilty of abuse of power with the use of violence and sentenced to 3 years and 6 months in a general regime colony. The court also deprived all three of their special ranks and the right to hold positions in law enforcement agencies for a period of 2 years. The police officers never admitted their guilt during the court hearings.

31-year-old Igor Krainov applied to the checkpoint in October 2019. The man said that on the evening of September 12, he was walking to work in Nizhpoligraph through an unlit yard and saw two men in civilian clothes approaching him. They shouted to him: “Stop, police!” Krainov did not believe that they were policemen, began to run away and ran into a building where CCTV cameras were installed – there they caught up with him. The recording from the cameras was added to the case file; it shows Krainov being beaten and being searched for something, checking the contents of his trouser pockets. According to Igor, he was struck more than 10-15 times during ten minutes, which he spent lying on the floor near the elevator. The police did not know about the existence of the camera at the time of the arrest.

Then the man was taken to police department No. 5 of the Ministry of Internal Affairs of the Russian Federation in Nizhny Novgorod, where late in the evening Krainov was personally searched in the presence of witnesses. A transparent bag, as it turned out later, containing three grams of mephedrone was found in the back left pocket of his jeans. A criminal case was opened against Krainov under the article “Illegal acquisition and storage without the purpose of selling narcotic drugs on a large scale” (Article 228 of the Criminal Code).

On October 3, CPT lawyers contacted the Investigative Committee on behalf of Igor Krainov with a report of the crime.

Commentary by CPT lawyer Yulia Osipova

We are pleased with the outcome of the criminal case against the ex-policemen. We consider the punishment to be proportionate and fair, taking into account the personality and role of each person. For us, it is undoubtedly important that the defendants received real sentences and were deprived of special titles. Let us note that the defendants during their testimony refused to answer questions from the public prosecutor, the victim and the court. In particular, on those questions that would allow us to establish additional mitigating circumstances, if any. Our work does not stop, because, of course, the verdict will be appealed by the defense and we will continue to represent Krainov’s interests during the consideration of the case
