​​The Moscow City Court obliged to compensate for moral harm for illegal criminal prosecution to businessman Evgeny Mulukov, recognized as a witness in the case against the former Minister of Economic Development of the Russian Federation Alexei Ulyukaev.

“The Moscow City Court recognized the decision of the Tver Court of Moscow to be legal on the partial satisfaction of the claim of Evgeny Mulukov to pay him compensation for moral damage for illegal criminal prosecution,” said Fyodor Trusov, manager of the lawyer bureau, who protects the interests of the applicant.
According to him, the reason for the initiation of a criminal case on allegedly extortion of 1 million rubles (in part 3 of Article 163 of the Criminal Code of the Russian Federation) was the statement of the former business partner of Mulukov – Mikhail Goluba when the parties arose between the parties arose a corporate dispute in 2015. At the same time, the case against the ex-owner of the company “Trade Naft” Mulukov twice stopped by the lack of an event of a crime: in 2017 and in 2018.
When the decision to terminate the criminal case has entered into legal force, Mulukov decided to recover moral damage of 1 million rubles from the federal budget, but the court reduced the amount of compensation by 10 times – up to 100 thousand rubles. However, the businessman did not appeal this decision; the Main Directorate of the Ministry of Internal Affairs of Russia in the Moscow Region turned to the Moscow City Court.
“For my client, this was a matter of principle,” said Fedor Trusov. According to him, the entrepreneur is going to transfer money received from the Ministry of Finance to one of the orphanages near Moscow.
The lawyer added that, by the decision of the Odintsovo City Court, Mulukov also official apologies for illegal criminal prosecution Odintsovo city prosecutor Yuri Chizhov.
The Investigative Committee of the Russian Federation recognized Mulukov as a witness in the case of the ex-head of the Ministry of Economic Development Alexei Ulyukaev, but he could not testify, since he left Russia, fearing the arrest.
