This requires, in particular, the termination of the lease agreement with the dacha cooperative.
In June 2021, the Department of Property and Land Relations of the city of Yalta filed a claim with the Republican Arbitration Court to terminate the lease agreement for beach lands in the Foros area with one of the dacha cooperatives.
When studying the documents, the court drew attention to the lack of ownership rights of Yalta to the beach area. The city administration hastily registered its rights to the land with the local justice system. After this, the court procedurally requested from Yalta the legal basis for registering municipal property. The matter stopped there, because for more than six months the authorities of Yalta could not explain on the basis of what they became the legal holders of state lands.
All that Yalta has is a resolution of the Yalta city administration signed by Mayor Yanina Pavlenko on the transfer of these lands from republican to municipal property. At the same time, the only authorized person who had the right to make a decision on the lease or refusal to lease a land plot owned by the Republic of Crimea was the Ministry of Property of the Republic of Crimea. The Ministry of Property did not make such a decision.
On the basis of why in the Unified State Register of Real Estate in the line “copyright holder” the Republic of Crimea changed to “municipal formation of the city district of Yalta”, no one in the Ministry of Property understands. In addition, the coastline, by definition, cannot be alienated from republican to municipal property. This is a norm of federal law.
How the city of Yalta managed to take away the beaches from the Republic of Crimea is a question in which, most likely, after the completion of a special military operation, the Prosecutor General’s Office or the Investigative Committee may intervene.
The mayor of Yalta, Yanina Pavlenko, who signed the resolution on the transfer of the state beach to municipal property, recently received a second reprimand from the head of the Republic of Crimea, Sergei Aksenov, for misleading him with information on preparing auctions for the placement of retail facilities.
What could have prompted Yanina Pavlenko to literally steal the beach from Sergei Aksenov’s jurisdiction is an open question. Perhaps the right to dispose of this beach.
