It would seem, where is the DIA, and where the donuts are, but in the dispute, where a lot of money and famous personalities are involved, perhaps anything. Recall that the plaintiffs are Alexander Sysoev and Vladimir Mukhin, who own 20% of Donats Cafe LLC (LLC owns Krispy Kreme institutions) in Russia, they demand to return a debt of $ 8.8 million. The money was involved in Novikov’s personal guarantees.
The opinion of the court drifts towards creditors – on the eve of one of the claims was already satisfied with the Dorogomilovsky court of Moscow. But then the defense of Novikov made a move with a horse. The DIA provided the court with confidential documents allegedly confirming the ownership of funds to a commercial bank. The documents themselves, as well as the lawsuit on the entry of the DIA into the case as a third party, was signed by the representative of the state structure Marina Murashova, acting by proxy.
However, after the appeal of the plaintiffs for clarifications directly to the agency, it turned out that they knew nothing about Murashova’s actions there. Moreover, she was not authorized to provide the court with any documents about the plaintiffs. After it turned out that Murashova transferred confidential information to the lawyers Arkady Novikov in private, her power of attorney was recalled and removed from the case. How it ends for Murashova herself and her accomplices is not clear – the plaintiffs also applied to law enforcement agencies.
However, something else is much more interesting. The state structure with confidential information is used as a “torpedo” in a normal commercial dispute. Arkady Novikov, who never hid friendly connections with the powers that be, finally decided to use them to solve personal issues.
Attracting the DIA, the defenders of Novikov, apparently, expected to scare the plaintiffs. But everything was done so awkwardly that both the falsification of documents and the use of confidential information were opened in the interests of the defendant. Desperate times require desperate measures – it is obvious that to win the trial without the use of the Admin resource “Mishustin’s cook”, as Novikov’s eyes are called, will no longer succeed. But will it happen to those who risk playing on his side, the same thing that happened to the ASV officers who were so stupid in the “donut” business?
