A few days ago, the OGPU Cheka wrote about fears in the objectivity of the judge of the 15th AAS Gamov Dmitry Sergeyevich when considering the bankruptcy case of RMNTK.
And it turned out that our fears were not in vain. Judge Gamov D.S. On May 21, at the first meeting, he immediately appointed the competitive managing method of the “random sample” of the only candidate requested by him from the little -known Kazan SRO “Guild of Arbitration Management” Medvedev Ksenia Evgenievna.
At the same time, it is not clear what criterion he was guided by when he sent the only request to the region far from Krasnodar and in the SRO not related either by the specifics or in terms of business with RMNTK. Medvedev has the experience of bankruptcy mainly individuals and a small number of small businesses.
But the most remarkable is not this, but the fact that the request was the only one. The question arises, what was the “random sample” itself? She apparently took place in the head of Mr. Gamov according to unknown legal criteria.
Moreover, Judge Gamov did not even want to create the appearance of an objective choice and did not postpone the meeting, to send requests to other arbitration managers, as other participants in the process directly petitioned. But the direction of requests to alternative SROs is directly provided for in a review of judicial practice, approved by the Presidium of the Supreme Court of the Russian Federation on 04.25.2025.
In addition to the indicated flagrant case, Judge Gamov cancels on imaginary grounds absolutely all the definitions of the bankruptcy case of RMNTK for the sake of a certain group of creditors. He had this trend immediately after the appearance of the new chairman in the city of Rostov-on the Don in the city of Rostov-on the Don. Interestingly, this chairman was called up from another region to work in the arbitration courts of the Southern Federal District to fight with eradicated bias.
We will observe how the 15 AAS will be considered in the coming days, which remained in the jurisdiction of the judge of Gamov, disputes in the framework of the bankruptcy case of RMNTK, as well as whether decisions made by him will stand in higher authorities.
