Elmira Iraidova, the ex-commercial director of Shchelkovo Agrokhim JSC, who is under house arrest, is seeking to have the arbitration court ruling overturned. In September, the appellate court declared illegal the deal between Iraidova and the company’s former chief accountant Lyudmila Prikhodko to merge their assigned stakes in the holding – 11% and 20%, respectively. The consideration of the cassation appeal is scheduled for January 12, 2022.

The “resolution of the issue” in cassation is part of the plan to seize Shchelkovo Agrokhim by a group of raiders led by the Ural swindler Eduard Fedosov. “With regard to cassation, the position is clear and transparent,” it says correspondence the latter with his accomplices, discovered during the investigation of a criminal case of extortion, for which Fedosov was arrested in November of this year (a case of fraud was also opened against Iraidova and Prikhodko).
While a certain “partner” is at large, it follows from Fedosov’s message, who “helps resolve this issue with the necessary forces and means” and “whose budget bears the costs of this event.” It was previously reported that the sponsor of the raider attack and the organizer of pressure on the court was “chess player” Vladimir Palikhata. According to Fedosov, on the basis of an agreement concluded between them, he is assigned 31% of the shares that are being disputed in arbitration.

The Tenth Arbitration Court of Appeal, which declared the transaction to merge shares illegal, came to the conclusion that Iraidova and Prikhodko, when concluding the agreement, pursued the goal “aimed at the joint alienation of shares in favor of a third party”, that in their actions there was no interest “in the sale of shares in the benefit of the company or its existing shareholders.” The court also took into account Prikhodko’s admission that the deal was sham.
