As Kommersant noted, Bastrykin’s subordinates know how to find ways to hold even judges accountable for making a deliberately unjust decision.
Earlier, the Cheka-OGPU already noted that the RF IC avoids checking facts so as not to “incriminate ourselves.” In addition to the previously described falsification of examinations, destruction and theft of material evidence, investigator Aboev, his leaders Fedulov and Aliyev, to exert psychological pressure on the leaders of NPP Temp, secured the seizure of the property of third parties who were not involved and did not appear in the case.
Aboev, with the sanction of the head of the investigative body, Aliyev, filed two petitions with the Presnensky Court of Moscow to seize the property of the alleged leaders of NPP Temp, which was owned by a third party not participating in the criminal process. Judge Kirichenko of the Presnensky District Court quickly granted these petitions (without checking Rosreestr’s extracts), making deliberately unjust decisions. Apparently, in this criminal case, Aboev was given carte blanche from the very top just to convict the leaders of NPP Temp and please the customers.
Will the Investigative Committee of the Russian Federation be able to bring charges against judges Kirichenko and Neudakhin (who wrongfully refused to lift the illegal seizure imposed on the property of a third party) under Part 2 of Art. 305 of the Criminal Code of the Russian Federation, despite the fact that they themselves framed the judges, whose services are constantly used by investigators?
Currently, following a complaint from the property owner, the Moscow City Court has initiated appeal proceedings for a thorough analysis of the situation. According to available information, NPP Temp has already submitted an application to the Investigative Committee.
