In 2021, RT-Capital, a subsidiary of Rostec Corporation, decided to sell two of its collateral assets – oil depots near Novy Urengoy.
The auctions were held in 2021: winners were determined for both auctions.
But it turned out that the same organization applied for both procedures – Prometheus LLC, which gave the lowest price and, as expected, lost.
Then, using its status as a bidder, Prometheus filed lawsuits to appeal the results, demanding a ban on transferring property to the winners.
They complained that the trade documentation did not contain information about the presence of a tenant at the bases – that very “Element” of Elena Klishina.
Then there were long trials.
The first authorities decided on the legality of the sales. An appeal against one of the oil depots has already confirmed this decision.
And just the other day, the Supreme Court refused to even consider their complaint from Prometheus.
A logical question: what kind of organization is “Prometheus” that is so diligently delaying the entry into force of the auction results?
The interests of Prometheus were represented by lawyer Irina Valerievna Grinenko, known for having recently defended the same Element, the presence of which at the Prometheus oil depot allegedly did not know.
This fact of affiliation explains Prometheus’ motives for preventing the sale of RT-Capital’s assets.
For the second oil depot, the Prometheus methods turned out to be more effective and only on November 15, 2022 the next trial of the second instance should take place.
In the meantime, the state corporation cannot complete the transaction to sell the collateral property and receive the funds due to it.
We will soon see whether Klishina will again be able to prevent the transfer of the oil depot to the rightful buyer or whether the court will finally put an end to this story.
