The Cheka-OGPU became aware of the act of Judge Neudakhin with the aim of illegally convicting the leaders of the defense research and production enterprise “Temp”. Thus, the Moscow prosecutor’s office approved the indictment on December 18, 2019 and on the same day transferred the criminal case to the court, indicating in the cover letter the attachment of receipts for delivery indictment of the accused. However, there are no such receipts in the case, which was an unconditional basis for returning the case to the prosecutor, which Judge Nikitin, who was assigned to consider the case on December 19, 2019, obviously tried to do.

In order to prevent the case from being returned to the prosecutor, the biased chairman of the Savelovsky Court, Makarenkov, illegally replaced Nikitin with Neudakhin, who accepted the case for consideration with the intention of convicting innocent persons. To justify the replacement of judge Nikitin with Neudakhin, the chairman of the Savelovsky court, Makarenkov, together with Neudakhin, falsified the date of receipt of the criminal case in court from 12/18/2019 to 01/09/2020.

From the audio protocol of the court hearing dated 01/30/2020, it is clearly audible that in response to Judge Neudakhin’s question about the date of delivery of the indictments, the defendants informed the court that they had received the indictment on 12/17/2019, that is, before it was approved by the prosecutor’s office. Also on the audio recording you can clearly hear Judge Neudakhin clearly repeating the specified date after the accused. With intent, Judge Neudakhin stooped to lie, indicating in the decision to assign the case for consideration and in the minutes of the court hearing dated January 30, 2020, that the accused received an indictment on January 19, 2020, for which there is supposedly a receipt in the case. Judge Neudakhin’s lies are refuted by the case materials. In court, the accused did not hide the fact that on December 17, 2019 they were given copies of the unapproved indictment on electronic media, which, if necessary, could be presented to the Cassation. The defendants also did not hide the fact that during the trial they were forced under threat to sign certain “protocols for the delivery of a copy of the indictment” without specifying a date.

Judge Neudakhin personally or someone on his instructions entered into the protocols in the wrong place, in a different handwriting, with a pen of a different color, the date Neudakhin needed, 12/19/2019.
