The case of the company “Three Whales” received a new turn and again becomes political. On June 11 of this year, the Land Court of Berlin recognized the right of the founder of the company Sergei Zuev on his assets, including the three whale complex.
The loud “furniture business” lasts many years. In the summer of 2006, lawyer Igor Romanov carried out a raider seizure of the company’s assets. And in 2019, the Arbitration Court of the Moscow Region made a significant decision on the return of the furniture empire to its legal owner Sergei Zuev. The German court in his decision went even further and decided: to oblige the defendant (to whom Igor Romanov is in the case file) to provide the plaintiff (Sergey Zuev – ed.) Partnership balance as of December 28, 2019 and give it to the plaintiff to determine the size of the plaintiff’s claim About compensation. In addition, the court ordered the plaintiff to provide all the information on transactions on the disposal of property, starting from 03.21.2007, as well as information on the whereabouts and use of the plaintiff’s retired property.
That is, the Berlin court was able to check and establish all the circumstances of this case, determine the degree of responsibility of all its defendants, and clearly formulate who is really the owner of the disputed property. The provisions of the court’s decision in which the court tried to determine where he lives and owns real estate novels deserves special attention. The defendant claims to be a citizen of Russia and a resident of the capital Zelenograd. However, it could not be found there. But representatives of German justice found several apartments, offices, a hotel and a house in Berlin, on the intercom of which a sign with the name Romanov and his wife, lawyer Inna Zaitseva, flaunts. Why Russian courts for so many years could not figure out this case and provide the legal owner of the company with the opportunity to fully protect their interests is a big question. And further development of events will be a very indicative example in discussion about the primacy of Russian judicial practice over international law.
