The Russian lawyer, as it is now, is living on, perhaps, its last days. It seems that she no longer suits not only citizens, but also power. Endless squabbles inside the corporation, unscrupulousness, rowing and unprofessionalism of lawyers became a lady in the tongue. In the power structures, the opinion was approved that not least, because of lawyers, the judicial system became a weak place in the hierarchy of power and that in order to restore order, the advocacy should be put under the possibly as much control of the state.

For two years now, as an organization that is not remarkable at first glance under the euphemical name “Center for the Study and Development of Intercultural Relations” has been developing an ideological substantiation and principles of activity for a completely new structure. This structure should become a way out of this situation. The output is simple, radical, cheap, reliable and logical. The working name of the new structure is “the corps of public advocacy under the Ministry of Justice of the Russian Federation”.

Simply put, this is a state advocacy. The state is forced to put the case of protecting citizens under its direct custody and make lawyers, at least part of them, public servants. The ideology of such a coup is already ready, the benefit of one of the founders of the above “center” is a philosopher who has been in the creation of the necessary ideologies, and part -time a great friend of Scientologists (hello to Sergey Vladilenovich Kiriyenko) Yuri Tikhonravov, co -author of the sensational “the theory of advocacy” at one time. The second founder of the Center and probably responsible for the development of the principles of the “corps” is a familiar with the problems of the current advocacy, Moscow lawyer Pavel Silkov. According to some information, responsible comrades do not disregard the characteristics of some investigators and judges given to them (contained in the analytical notes of the “center”).

From the meaning of the concept developed by the Center, it is clear that the state advocacy will be a “lawyer for the poor”. That is, for those who cannot afford expensive lawyers, but are forced today to be content with those who will be sent to the lawyer chambers to call investigators or courts. We are talking about criminal processes and the so -called “lawyers for their intended purpose”. The main goal of the created “corps” is declared “the exercise of public supervision of compliance with the rights of the accused and the victims.”

The principles of the new advocacy are also carefully thought out. Lawyers will be divided into two professional contours: a lawyer for the rich and a bar for the poor. In the first circuit, lawyer firms are concentrated, ensuring the interests of large and medium -sized business circles, as well as protection against criminal prosecution of wealthy persons. The second circuit designed to provide legal assistance to the poor is formed from lawyers who neglected the refuge in these companies. These lawyers will compose a “public advocacy corps”.

The creation of the “corps” will not require any additional expenses. State funds for the provision of legal assistance in such cases are already allocated. These and other targeted funds will be directed exclusively to the Ministry of Justice of Russia, which also has its own interest. It will finally become an effective participant in justice, and not just the registrar and the contractor of other people’s decisions. To achieve the goal, most likely it will be necessary to reanimate the “Law on Professional Legal Assistance”. But this is a matter of technology, and it will probably already be done by the new Minister of Justice.
