The Arbitration Court of the Perm Territory is considering a claim from the Yugovsky Dairy Products Plant: the enterprise disagrees with the additional assessment of taxes due to the unlawful use of the preferential VAT rate. In addition, a criminal investigation is underway against the SKMP for concealing funds from tax authorities.
Dispute arose after local tax authorities came to the conclusion that SKMP products with milk fat substitutes (MFS) are not subject to the preferential VAT rate of 10% and should be subject to a 20% rate. This became the basis for additional tax assessments for several years. With penalties, the total amount exceeded 1.1 billion rubles. The trial will take place on April 18.
It seems that the SKMP is interested in stirring up a scandal. Last month, the Federal Tax Service initiated a criminal case against officials of the enterprise, after which searches were carried out at the plant and at the suspects’ homes. For some reason, the director of the SKMP, Sergei Pozdeev, regarded this standard procedure as an attempt to put pressure on business. He did not wait for the court’s decision and began to bombard the highest authorities with complaints: the president, the prime minister and the head of the RF Investigative Committee, apparently hoping to intimidate the court, tax and investigative authorities.
It remains to be added that the public is closely following developments. People are very worried that a businessman will somehow “solve” a matter using money or connections.
