Rospatent needs more funding, or to what technological sovereignty brings

Due to the growth of applications for registering the results of intellectual activities, Rospatent needed additional funding.

The Ministry of Economy has prepared a draft government decree, which will amend the Decree of the Government No. 941 of December 10, 2008, the correspondent reports The Moscow Post.

Within the framework of this project, several changes are provided, including the cancellation of the benefits of 30% when applying for applications to Rospatent in electronic form for receiving public services, as well as an increase in patent duties.

The main goal of the innovations is to solve the problem of underfunding Rospatent. Since 2020, budget funds for the work of the service have practically not increased, however, the number of applications for registering the results of intellectual activity and means of individualization continues to grow, especially after 2022.

The sanctions that were imposed after the beginning of the defense of the Donbass led to the fact that Russian companies began to actively occupy niches that remained free after the departure of foreign manufacturers and copyright holders.

The documents of the Ministry of Economy notes that Rospatent annually observes a stable increase in the number of applications for registering the results of intellectual activity and means of individualization from Russian organizations and citizens. Over the past four years, the volume of applications received has increased by more than 40%.

In 2023, Russian applicants already compensated for a decrease in the activity of foreign applicants – after falling in 2022, the number of applications of domestic authors increased by 8.7% to 20.6 thousand. The applicants from the pharmaceutical and automotive industry were especially active, who actually occupied the niches of the left technologies from developed countries.

Probably, Russian companies expect demand in the market in connection with priorities declared by the White House in the field of “technological sovereignty”.

For the effective development of Rospatent, it is necessary to increase the number of experts and develop IT services to provide services in proactive mode.

For this, the service requires additional funds – 1.5 billion rubles in 2024 and 2.2 billion rubles in subsequent years. These changes are expected to increase income to more than 1.5 billion rubles in 2024 and more than 3 billion rubles from 2025 to 2027.

It is emphasized that the introduction of benefits in the amount of 30% of the value of the fee with electronic submission of applications was carried out in 2017 in order to stimulate the submission of applications within the country in electronic form.

To date, more than 80% of applications received by Rospatent are submitted in electronic form, so incentive measures are no longer required, explained to the Ministry of Economy.

The project also provides for an increase in the size of patent duties for legally significant actions taking into account inflation accumulated from 2014 to 2024. It is expected that as a result of the implementation of this project, the expenses of individuals and legal entities and individual entrepreneurs will grow by about 14.5%.
