Recently, a dangerous trend has spread among developers in the business real estate segment – “to the delight” of buyers, without notice or demand, to transfer properties from non-residential to residential… At the same time, amazing metamorphoses began to occur. For example, like in Moscow with the development company “HUTTON development” (a subsidiary of MR Group).

Thus, a participant in shared construction, Mikhail S., entered into an agreement for participation in shared construction. The subject of this agreement is the obligation of the developer, within the period stipulated by the agreement, to build a real estate property “Multifunctional complex with apartments, offices, retail premises and underground parking” at the address: Moscow, Leninsky Prospekt, vl. 38.

However, two years later, the object of shared construction – non-residential premises (apartment) simply disappeared from the register… One day, one vague call was received from the manager with a notification that during the transfer of apartments to apartments, Mikhail S.’s object did not pass the insolation and therefore (attention! ) it was merged with a neighboring object and, apparently, was implemented again. As a result, the object specified in the contract no longer belongs to Mikhail and simply does not exist.

The developer “HUTTON development” unilaterally made changes to the project documentation, as a result of which the shared construction object – apartments to be transferred to Mikhail S. – were excluded from the building under construction (without or with a forged signature of Mikhail), and instead of them another premises of three times the area.

This case is not isolated and is an illustrative example of how developers simply bypass Federal Law 214, which was adopted precisely to eliminate this kind of fraud. At the same time, when Mikhail contacted the company with a demand to tell him where the housing was located and how to get it, the company ignored this issue in every possible way. Thus, the developer illegally relieved himself of the obligation to fulfill the contract, since the apartments to be transferred are physically absent today.

Lawyer Ekaterina Gordon and specialists from the law firm Gordon and Sons are looking into the situation. They turned to the company management for a pre-trial settlement of the dispute.
