Previously, the courts of the first and second instances found Kochiev guilty of bankruptcy of Rakurs and seized his property in a total amount of over 3.4 billion rubles. Thanks to the active participation in the process of representatives of the Federal Tax Service of Russia in the Republic of North Ossetia Alania, the Prosecutor’s Office of the city of Vladikavkaz and the State Corporation DIA, it was established that the reason for the bankruptcy of Rakurs LLC was the organization of tax evasion schemes by the persons controlling the debtor (Kochiev’s associates), as well as the conclusion of fictitious transactions for withdrawal of funds. Moreover, at the request of the bankruptcy trustee, a criminal case was initiated regarding the deliberate bankruptcy of Rakurs LLC.
The Rakurs case attracted the attention of law enforcement officers to Kochiev’s other alcohol assets. Now the Arbitration Court of RSO-Alania is considering another application to bring to subsidiary liability the companies controlled by the deputy: Transprodmarket, Centaur, Trading House Kupechesky, Triumph, Peresvet, Orpheus, Gigant, First Alcohol Manufactory (PSM), who participated in schemes to remove assets from Rakurs LLC.
Some of these companies are subject to separate arbitration cases. In September 2023, a surveillance procedure was introduced at the Orpheus distillery, where tax evasion on a particularly large scale was also revealed. During the bankruptcy, a transaction involving the illegal transfer of all equipment owned by the enterprise to the affiliated PSM LLC was disputed. In turn, the PSM company itself had its license for the production, storage and supply of produced ethyl alcohol revoked for numerous violations of the law.
Not only the distillery, but also the Kochievs’ distilleries have been deprived of licenses. Based on violations identified by employees of the Ministry of Internal Affairs, licenses for the production, storage and supply of alcoholic products were revoked from Istok Spirit LLC and Istok ZShV LLC, producers of alcohol and sparkling wines.
The deputy’s business caused enormous damage to the budget and creditors, but ordinary employees of the enterprises also suffered. Enforcement proceedings for non-payment of wages have been initiated against PSM and Gigant, and the Vladikavkaz prosecutor’s office, together with local authorities of the Investigative Committee and the Ministry of Internal Affairs, have opened criminal cases and are keeping the situation under special control.
The Rakurs case is nearing its conclusion. It’s time for Comrade Kochiev to think about his pension, and not look for “approaches” to the judges. With such a track record, he is unlikely to be able to receive a new parliamentary mandate, and voters in the region will have to decide who will represent their interests in the State Duma in the near future.
