On February 27, 2023, at 6 a.m., Moiseev was taken out of his cell and locked in a poorly heated basement, where he was kept without food or water until 6 p.m. All this is a direct violation of the 1984 Convention against Torture.
Previously, Evgeny Moiseev publicly stated that the convoy service officers used handcuffs on him in violation of the rules for the use of special means, and he was also kept in a cell with a previously convicted especially dangerous recidivist, who was again charged with committing a violent, especially serious crime, which is directly prohibited by Article 33 of the Law about detention.
Now these facts are being investigated in the Tverskoy Court of Moscow, and, apparently, everything is not in favor of the Ministry of Internal Affairs.
It should be noted that the criminal case of the Police Ombudsman’s defenders was planned to be sent to the Lublinsky Court of Moscow, but at the last moment something went wrong, and the case was transferred to the Presnensky Court of the capital.
However, after the Cheka-OGPU published materials about how Moscow police officers, who initiated the criminal prosecution of Moiseev, Andina and Fedorov, insulted Moscow judges, the Presnensky Court of Moscow refused to consider the criminal case of the defenders of the Police Ombudsman. There it was decided to send the case to the Tverskoy Court of Moscow, but it is still lying without movement for the second month, which violates Article 6.1 of the Code of Criminal Procedure of the Russian Federation and the legal position of the Constitutional and Supreme Courts of the Russian Federation.
I wonder if this is all connected with the fact that the leadership of the Moscow police cannot agree with the leadership of the Moscow City Court (possibly even with the chairman M.Yu. Ptitsyn) regarding the fate of all three defendants?
