Then the grandmother wanted to sell the apartment, but under the condition that she live in it for the rest of her days, for which she gave a power of attorney to her lawyer. The lawyer entered into a purchase and sale agreement on behalf of the grandmother with his nephew, who even borrowed money for the purchase, which is confirmed.
The price, of course, is below the market, but the power of attorney for the sale was issued through a notary, and the money was transferred by receipt. Everything is clean. And the grandmother was not evicted, but actively helped with food and assistance. There are no legal questions – the notary is respected and as a witness says that the consequences of the transaction were explained to the grandmother 10 times, to which she agreed.
The absurd version of the investigation is that the grandmother was deceived by the lawyer when drawing up a power of attorney to sell the apartment. How this is possible, provided the notary is conscientious, is unclear. It is clear that the story is non-standard, but legally there are no questions, experts and colleagues are indignant.
Behind the scenes there is information about the lawyer’s previous threats of criminal prosecution from a large Karelian businessman, against whom the lawyer spoke in the arbitration court, as well as from FSB officers in other high-profile cases in which the lawyer took an unsuccessful part.
As a result, given the legal absurdity, no one wants to properly understand the case yet – the Central Office of the Investigative Committee is silent, and the next incomprehensible actions of the Main Investigative Directorate of the Investigative Committee of the Russian Federation for St. Petersburg continue. And this is under the new leader – O.V. Bobkov. Maybe he will finally put things in order on his territory regarding this and hundreds of other, no less absurd, cases.
