Judge Chinaeva E.A. Convicted Magomedov Amir Abduldzhalilovich in the case of “illegal possession of weapons and drugs”, re-arresting him and sending him to a colony for 4 and a half years.
Apparently, the same sentence awaits Islam Yahogoev, a former opera singer and friend of Magomedov, in September in a similar case.
Briefly about the circumstances of what happened on September 8, 2018 in Nalchik.
Yakhogoev and Magomedov were detained in the parking lot of the latter’s house at the address: Nalchik, st. Chernyshevskogo, 95 “a” by employees of the Center for Specialized Execution of the Ministry of Internal Affairs for the Kabardino-Balkarian Republic, beaten and handcuffed. After that, the officers who detained Magomedov and Yakhogoev stuffed each of them with a pistol in their belts and a bag in their jeans pockets (as it later turned out – a narcotic drug). And investigator E.V. Ulbashev, who arrived about an hour later at the place as part of the SOG, carried out an action that he called “inspection of the scene of the incident” – he examined the parking lot and the adjacent territory, during which he discovered Magomedov and Yakhogoev handcuffed – and when them – prohibited items and substances.
Then there were arrests, attempts to force “confessions, otherwise it would be worse.”
The “case of Ivan Golunov” and the words of the President came at the right time: “It’s not injustice, it’s arbitrariness. And it must be investigated…”, – which made such a strong impression on the local falsifiers that Magomedov and Yakhogoev were released from custody, and then for another 2 years they did not know what to do with the case.
Despite the principled position of Deputy Prosecutor S.D. Belov, who recognized the impossibility of sending the case to court due to procedural violations (supervisory ruling of the Supreme Court dated August 10, 2006 N11-D06-40), years later the case was nevertheless sent to court.
All this time, it was widely discussed that planting drugs on two athletes, a karateka and a wrestler, multiple winners of competitions, promoting a healthy image and enjoying unquestioned authority among young people, was an attempt to humiliate and “show off their place.”
The uniqueness of this case, unfortunately, is not determined by the fact of planting weapons and drugs. Alas, in the region over the past few years this has been the usual and well-known way for pseudo-security forces to fight against undesirables.
The peculiarity of this case lies in the planting and falsification of evidence.
This reason is the conflict between Magomedov and Yakhogoev with the chief of police of the region, Mamkhegov Nazer Msostoivich, over a commercial dispute.
The businessman-policeman Mamkhegov initially offered 10 million rubles to settle the dispute, and after Magomedov and Yakhogoev refused, he said that “then he will deal with them differently.”
And he decided to send his “native” unit, the Center for Drug Enforcement, to plant drugs.
The case became so important and painful for Mamkhegov, one might say “reputational”, that he appointed “his judge” to pronounce the verdict – the wife of his deputy Anakhaev Kazim Tagirovich and “the best friend of his family” – the aforementioned Chinaeva E.A.
And it would seem that this is a story with a sad ending. Mamkhegov flaunts that the court is controlled by him and his patrons not only in Nalchik and the Supreme Court of the region, but also higher – in the cassation instance. And the Investigative Committee employees who examined the materials about the falsification of evidence are toothless and dependent even at the level of the North Caucasus Federal District.
But that’s not true.
What happened made it possible to take a very close look at the activities of the Ministry of Internal Affairs of the Kabardino-Balkarian Republic and other regional security elites.
