There was only one way to buy up land: Makarevich’s henchmen (in this case A.S. Budilov) found someone willing to sell their land share, offering a higher price. The person agrees, but the parties do not enter into a purchase and sale agreement, but a fictitious loan agreement, according to which the oligarch’s representative Budilov allegedly lent money to the participant in shared ownership. After drawing up the said agreement, Budilov, acting in the interests and at the direction of Makarevich, files a lawsuit in court demanding the return of the money, in court the parties either enter into a settlement agreement, or a ruling is made to change the method of execution, on the basis of which the court issues a decision in which it is written, that in payment of the debt it is necessary to transfer a share in the land plot.
As everyone understands, the court does not conduct an examination of the value of the share, does not check the reality of the loan (a mandatory condition by law), it simply makes the “correct” decision. And then Makarevich’s representative goes to Rosreestr not with an agreement, but with a court decision, according to which it is ordered to register property rights. And Rosreestr does this because it cannot fail to comply with the judicial act. And so the deed was done: the ban was bypassed and the necessary people became participants in shared ownership. According to this scheme, Alexey Budilov (and in reality Makarevich) became the owner of shares in Dinsky and other districts of the Krasnodar Territory…”
