It may seem that, in solving the problem of defrauded shareholders, the authorities are bending over backwards to, if not hand them the keys to the apartment, then at least return the money. However, developers have repeatedly noted that it was precisely the absurd decisions of officials that often multiplied the number of shareholders left homeless.
Another example is the recent litigation in Irkutsk, where the local construction company AZGI had difficulty fighting off the claims of the prosecutor’s office. But there are no guarantees that the matter will not go into a new circle.

The story is connected with the territory of the disbanded Irkutsk Higher Military Aviation Engineering School (IVVAIU), which in the early 2000s was given to the construction company IZKV for residential development. By 2015, IZKV had built 15 houses and went bankrupt without having time to fulfill all its obligations to shareholders. But three years later, they still managed to find a solution to their problems: the construction company AZGI acted as a new investor in the construction, taking on not only the obligations of IZKV to shareholders, but also all the encumbrances of its predecessor, in particular, a debt in the amount of 96 million rubles Ministry of Defense. In general, the construction company spent over 600 million rubles on solving all problems.

And just when the company was ready to hand over the keys to the apartments to the shareholders, a beautiful fairy tale at the beginning of this year, the prosecutor’s office suddenly decided to break off the case, having decided to initiate proceedings in connection with the 2007 document – the former head of IVVAIU Igor Velichko wrote a statement saying that he had not signed the documents on allocation of school territory for construction.
It is curious that the document was signed with the IZKV company, but for some reason the prosecutors arrested six representatives from AZGI. But, perhaps, it is even more “fun” to imagine the social consequences of this unhealthy excitement of prosecutors: dozens of apartment buildings, hundreds of apartments, thousands of residents – the houses must be demolished, people, including families with children, must be driven out onto the street. And all just because someone said that he didn’t sign some paper 14 years ago!
By the way, the examination shows that Velichko’s signature on the document is most likely real. But for some reason the prosecutor’s office ignored not only this, but also the fact that the signatory was not the only one, and also that the Ministry of Defense, which was the owner of the lands, did not file any protests, moreover, received money and apartments for them.

Now the law has sided with investors, and the case in the Arbitration Court has been won. But lawyer Shota Gorgadze believes that the prosecutor’s office can still file an appeal, and the case will start anew. Moreover, serious questions remain that require answers. “What would happen if the prosecutor won in the Arbitration Court, which they already lost in the first instance? – says lawyer Shota Gorgadze. – Hundreds of people would be on the street! If this plot of land were to leave the hands of the developer, then all construction on this plot would be illegal. People would have to be evicted from those houses. And whoever invested in the construction would also have to end up on the street. Second point: what is a construction business? These are thousands of people involved, thousands of jobs. If the local prosecutor’s office had managed to do what they wanted, then the AZGI company would have gone bankrupt. People would be out of work
Considering that the AZGI case has all the signs of being ordered, members of the expert council in the Federation Council, where they examined this story, unanimously came to the conclusion that the Prosecutor General’s Office, as well as the Investigative Committee of the Russian Federation, must take up this case. Senator Elena Afanasyeva and State Duma deputy Elena Drapenko promised to make a request so that this situation would be resolved as soon as possible.
