The counterfeit is blocked by the path: it is proposed to establish criminal liability for the import of products without marking.
The author of the initiative was the Ministry of Industry and Trade, the correspondent reports The Moscow Post. There is a marking system “Honest Sign”it has been introduced in the country for several years. It is needed to combat illegal products.
The Ministry of Industry and Trade offers to make the import of products without marking become a criminal offense, we managed to get acquainted with the document “Izvestia” – According to the publication, it is proposed to adjust Art. 171.1 of the Criminal Code of the Russian Federation (“Production, purchase, storage, transportation or sale of goods and products without marking and (or) the application of information provided for by the legislation of the Russian Federation”).
Now the punishment is not established precisely for the import of non -marked goods. However, sanctions on suppliers are imposed for the import of counterfeit alcohol and new potentially dangerous psychoactive substances.
The authors of the bill believe that it is necessary to make amendments to the current legislation. Namely, to increase the list of punished acts, adding points – “import into the territory of the Russian Federation.” If the document will eventually be accepted and entered into force, then the importers of counterfeit can face a fine (up to 300 thousand rubles), as well as up to three years of forced work or imprisonment. Well, if the violator is a group of persons, then even more.
The specialized ministry said that this proposed measure is aimed at suppressing the domestic market illegally imported, non -targeted products, it will also ensure additional protection of consumer rights buying imported products to mandatory labeling.
The document ideally should help fight counterfeit, which is not only illegal, but also dangerous to health.
Lawyer, candidate of legal sciences Armine Grigoryan believes that these edits will ensure additional protection of consumer rights.
Speaking of marketing. Just recently, the mandatory marking of red and black caviar has started. What does this mean in practice – manufacturers, importers and distributors should apply the marking code for the entire caviar of sturgeon and salmon fish produced after May 1 of this year, and provide data on the commissioning of products into the circulation into the marking system.
Earlier, the authorities also increased control over the import of pesticides and agrochemicals. Since 2021, pesticides and agrochemicals can be transported to the country only through certain border checkpoints. This is also a kind of struggle against dangerous counterfeit.
