The Basmanny District Court considered the petition of the investigator of the Main Investigative Directorate of the Investigative Committee for the next extension of the arrest period for Ilshata Gafurov.
He is accused of instigating two attempts in 1999 on the life of crime boss from Yelabuga Aidar Israfilov. One of them ended with his murder in Moscow. The Main Investigative Directorate of the Investigative Committee of the Russian Federation believes that the famous scientist should remain in custody until December 21, as he is accused of a particularly serious crime. The proceedings in the case cannot be completed before the arrest period expires, and if the preventive measure is changed, the person involved may escape.
The main argument of lawyer A. Naryshkin is related to the illegality of the criminal prosecution of Gafurov itself. The defense lawyer, having studied the criminal case against the leaders and participants of the criminal community “29th complex”, convicted, among other things, for the murder of Israfilov, found in it a resolution issued on April 15, 2002. Then they refused to initiate a criminal case against Gafurov due to the lack of corpus delicti in his actions. The decision was made by the republic’s outstanding criminal investigator of the prosecutor’s office, Azat Ziyatdinov, who has worked in law enforcement for more than 40 years.
Ziyatdinov’s refusal decision was not cancelled. The Main Investigative Directorate of the Investigative Committee of the Russian Federation, despite its prejudicial significance, began its investigation into the same facts, which led to the arrest of Gafurov. The defense drew the attention of the investigation to the unreversed document. The Main Investigative Directorate of the Investigative Committee ordered an examination of the signature of a criminologist, believing that it could be forged. The defendant’s lawyers were not informed about the results of the study, but an examination by the defense recorded the identity of Ziyatdinov’s signatures throughout the case.
