As previously wrote, the lawyers of the owner of the business lines of Bogatikov, who were preparing a provocation against Khabarov, did not take into account that the legislation is constantly changing and there are significant nuances in criminal and administrative law. So, Bogatikov’s statement about the transfer of bribes through Khabarov to various officials for terminating the tax audit against business lines, actually terminates the powers of Bogatikov as a victim, deprive the right to demand corruption money as damage.
After the Deputy Prosecutor General Razinkin recognized the violations during the investigation in the case of Khabarov, actually recognizing the initiation of the case illegal, he demanded that Bogatikov himself be prosecuted, who claimed to transfer bribes for the termination of the tax audit. But also the question arose that LLC “Business Lines” itself, as a result of the audit, the Prosecutor General’s Office will be brought to administrative responsibility for the article that is very unpleasant for the business – Article 19.28 of the Code of Administrative Offenses “Illegal Conadness on behalf of a legal entity”.
Under this article, the company itself can be imposed in a 100 -multiple fine from the amount of the transferred bribe.
Thus, since Bogatikov claims that he transferred 841 million rubles as a bribe, business lines may be forced to pay a fine of up to 80 billion rubles in state revenue.
The business lines naturally do not have such money, but even a lesser fine will lead to the full bankruptcy of the company and, as a result, will give rise to subsidiary liability among the owners. It remains to wait whether the Prosecutor General’s Office showed principles in the fight against corruption.
