According to a source of the Cheka-OGPU, a criminal case has been opened under Part 4 of Art. 159 of the Criminal Code of the Russian Federation regarding the theft of 284 million budget rubles allocated to Cheboksary Electrical Apparatus Plant JSC for the development and organization of serial production of powerful high-voltage variable frequency drives (VCFD).

Earlier it was reported that the Arbitration Court of Chuvashia, at the request of the Prosecutor’s Office, is considering case No. A79-1139/2020 on the collection of the above amount from ChEAZ and USNTU in a joint and several manner to the budget of the Russian Federation. 02/03/2021 by court decision a forensic examination was appointed for the official 920 thousand rubles in the Nizhny Novgorod LLC Independent Professional Association “Expert Union” proposed by JSC “CHEAZ” to determine the scope and compliance of work performed under the contract.

As it turned out, the expert organization examined an unknown sample of HFFD for a 2.1 MW engine, instead of allegedly developed and long-manufactured samples with parameters of 8 MW, and made unfounded conclusions. As a result The prosecutor’s office had claims not only against the examination, but also against the NGO Expert Union itself.

The expert organization has extensive experience in providing deliberately false conclusions to the courts, and there is information about the initiation of a criminal case against its experts. Thus, according to the decision of the First Arbitration Court of Appeal dated November 7, 2016 No. 01AP-3047/08 in case No. A43-7264/2008, experts of NPO Expert Soyuz LLC, when calculating the cost of restoration and construction work and determining the amount of lost profits, included virtual indicators. This led to an unreasonable overestimation of the amount of damage (Part 1 of Article 307 of the Criminal Code of the Russian Federation, giving a knowingly false conclusion). These conclusions led to the cancellation of the previously adopted court decision due to newly discovered circumstances, and the criminal case initiated on this fact was subsequently terminated on non-exonerating grounds.

Later, by decision of the Arbitration Court of the Nizhny Novgorod Region in case No. A43-54697/2019, NPO Expert Soyuz LLC was awarded damages in connection with giving a knowingly false conclusion in case No. A43-7264/2008. We note that the expert opinions of NPO Expert Union LLC repeatedly were not accepted by the courts at all, and repeated examinations were ordered after the examinations carried out by this organization. Thus, the Arbitration Court of the Volga-Vyatka District of September 21, 2021 No. F01-3952/21 in case No. A43-53228/2019 did not accept the Expert Union examination as proper evidence, since the expert’s conclusions are presumptive in nature, and the expert’s research nothing justified. Also, similar decisions on the examinations of NPO Expert Union were made by the courts in case A43-21828/2019 and others.

In the actions of JSC “CHEAZ” and LLC NPO “Expert Union” there are signs of conspiracy to obtain an expert opinion with a known result. Informed sources name the amount of remuneration for the expert organization in the amount of 10% of the amount of the claim, allegedly paid by the chairman of the board of directors of CHEAZ Mikhail Shurdov for a false examination.

Under such circumstances, the examination of NPO Expert Union LLC, carried out as part of the consideration of case No. A79-1139/2020, not only raises doubts, but also indicates signs of giving a deliberately false conclusion.

While the Chairman of the Board of Directors of CHEAZ JSC, Mikhail Shurdov, finances information campaigns against competitors, discredits the law enforcement agencies of Chuvashia, pushes dubious examinations, financial and economic activities at his plant are falling apart and debt has accumulated to financial and credit institutions.
