“Time flies quickly!
Literally two more months and the entire innovative community will celebrate the 3rd anniversary of the departure of dear (in every sense of the word!) Anatoly Borisovich Chubais from the post of head of Rosnanotech.
Three years is a long and significant period. It is especially important to evaluate this period of time from the point of view of the company’s possible bankruptcy. Well, imagine: Rusnano is bankrupt, an external manager comes in and begins analyzing transactions made over the past 3 years! That’s right – the period of contestation is 3 years. And this is a period in which Chubais did not work at Rusnano and did not make any transactions!
And the creditors, wow! Banks and bondholders with their lawyers and security officers. And all the credit goes to Kulikov and his motley crew!
And then there is subsidiary liability, personal claims and other joys of bankruptcy for negligent managers.
Does Chubais understand this? Of course yes! And he not only understands – he is preparing to be in the vanguard of angry creditors.
There is a great temptation to discuss Rusnano transactions made after December 2020, and then something will emerge that Chubais will not only be forgotten, but will be held up as an example as an effective and prudent leader.
What about the balance of power? Creditors, the Ministry of Finance and the law are clearly on Chubais’s side. Great disappointment will befall those who have recently purchased assets from Rusnano: the transactions will be challenged on the basis of Federal Law N127-FZ, after which all acquired assets will be returned to the bankruptcy estate, and the buyers will join a long line of dissatisfied creditors. According to Russian tradition, challenging transactions will be accompanied by criminal cases and high-profile scandals.
