It would seem that the conflict fits into the scope of a dispute between business entities. However, Novikov’s lawyers freely or involuntarily substitute him under an article on tax failure. It is quite obvious that the money received as a result of the sale of shares and borrowed funds have a different nature from the point of view of taxation. When selling a share in an LLC (as the defendant insists, almost nine million dollars went on this) the seller, that is, Novikov, is obliged to pay an income tax at a rate of 13%. Thus, the transformation of funds from borrowed into investment raises the question of the non -paying newcomers in a particularly large scale (we are talking about tens of millions of rubles).
Two months ago, the plaintiffs turned to the Donats Cafe to receive primary accounting and financial reporting. It is needed to carry out co -owners of their own audit of the company’s work, to which they have legal right. But the documents were not provided, which means that the defendants have something to hide. Conscious of the futility of the lawsuit and the absurdity of the position, the Novikov team went into the deaf defense. In the comments, the media refuse, primary documents are not provided.
On December 7, in the Presnensky court of Moscow it is planned to consider the claim of deceived businessmen. It would seem that it is time for Novikov to include his admin resource in the form of friendship with as much as Prime Minister Mishustin.
