Returning from an aerial surveillance position in the spring of 2023, serviceman Mustafa Mustafayev asked a colleague to film him with an AK-74. At the same time, the soldier forgot to disconnect the magazine with cartridges from the machine gun, removed the weapon from the safety catch, jerked the bolt, pointed the barrel towards the person removing it and pulled the trigger. Two shots were fired, from which the conscript died on the spot.
The court of first instance sentenced Mustafayev to three years in a penal colony. The appellate court commuted the sentence to 11 months and excluded from the descriptive and motivational part of the sentence the aggravating circumstance that “the defendant’s commission of a crime that resulted in the death of a serviceman entails a decrease in the combat readiness of the unit, which significantly increases the degree of public danger of the crime.”
The death of the serviceman exposes the lie of the Ministry of Defense that conscripts will not be involved in the “special operation”. As follows from the appeal ruling, the commander of the military unit on April 21 sent both of them on a business trip “to perform special defense tasks.”
