The latest decision of the judge, whose actions have been observed for quite some time, amazed not only the investigative authorities, but also the prosecutor’s office.
Earlier, as the Cheka-OGPU reported, Zinkovskaya had already helped the “chemists” to release from custody under house arrest Alexander Balakhovsky, the main organizer of the case of the theft of a share worth $5 million from lawyer and famous “fixer” Denis Shapiro (Zolotov). By the way, she herself chose a preventive measure for Balakhovsky in the form of detention, but suddenly, for the same reasons, she refused to extend it. Then the judge’s decision included non-existent minor children and a “fraudulent” medical report from a commercial clinic that did not even examine its patient.
In October 2021, judge of the same court Valery Glukh authorized the arrest in absentia of Balakhovsky and Bosinzon’s accomplice Kapilista, who fled and was put on the wanted list on charges of abuse of power (Part 2 of Article 201 of the Criminal Code of the Russian Federation). However, the defendants, through the Moscow City Court, organized the reversal of this decision. The materials for re-arrest surprisingly went to the irreplaceable judge Zinkovskaya, who on December 27 last year did not consider the investigator’s petition and stunned the prosecutor present in the hall that the hearing was postponed to January 13, 2022 due to his failure to appear. The next meeting was also postponed to February 8. The parties notified about this, and the information was posted on the official website of the courts of general jurisdiction of the city of Moscow.
But Zinkovskaya did not wait for the next date and held a meeting in secret from the investigation on the evening of February 2. As it became known from the assistant judge Alla, the investigator of the Investigation Department for the Southern Administrative District of the Main Investigative Directorate of the Investigative Committee of the Russian Federation was informed about the hearing an hour before the meeting. But he informed the assistant judge that on January 31, 2022, the case was seized from him and transferred for investigation to the Main Investigation Department of the Investigative Committee of the Russian Federation in Moscow, so he has no right to participate in the process.
The fact that the Chertanovsky Court of Moscow could not consider the investigation’s request (the case has now transferred to the jurisdiction of the Presnensky Court) did not bother the judge: she refused to arrest Kaplista in absentia (pictured) without an investigator and without a representative of the victim, lawyer Roman Kandaurov, who had previously participated in all meetings on the case. The latter discovered in his email that a letter from the portal of the courts of general jurisdiction of the city of Moscow was sent on February 2 at 18:29. It stated that there had been changes in the case and the date and time of the meeting had changed to February 2 at 10 am – that is, the notice appeared when the decision had actually already taken place. It is worth noting that on the website of the Chertanovsky Court there is still no information about the judge’s decision based on the results of the trial, which miraculously included only two defenders of Olesya Kaplista and the prosecutor who demanded the arrest of the accused.
It is clear to everyone that Judge Zinkovskaya committed such violations not because of Kaplista’s pretty eyes, but most likely because of the “beautiful” proposal of the main organizer of the crime, co-owner of the V&V holding, Alexander Balakhovsky, and his intermediaries, whom the FSB has been monitoring for a long time. It is extremely important for him to save one of the key accused, who, if she is detained, can tell interesting facts about how the trademarks of a company with billions of dollars in revenue were stolen. But soon they will be handcuffed.
