In the case of Moscow Spartak football player Mikhail Ignatov, everything initially developed more or less fairly. Although the RFU Chamber collected a penalty from the athlete, the amount was small. Subsequently, in an appeal (to the RFU Committee), this penalty was canceled altogether.
But the crooked football officials left a loophole in the decision, which allowed A. Manyakov to appeal once again to the RFU judicial body, but not on the issue of whether M. Ignatov terminated the contract legally or illegally, but with a demand to recover damages.
It is logical that when the Chamber appealed again, the agent’s attempt to get money out of thin air remained unanswered. But miracles began already in the Committee – unexpectedly the demand was satisfied, almost 10 million rubles were recovered from the football player. At the same time, no one began to disclose the question of what exactly the agent’s losses were for services not provided in the contract that was valid for 1.5 months.
The secrets of such trick decisions are revealed when you read the biographies of A. Manyakov’s representatives in disputes. Among them is a partner in one of the law firms, Yu.V. Zaytsev, whose biography directly states his long-term work at the RFU. Find a common language with former colleagues?! – Easily!
This is not the first time that A. Manyakov himself has been connected with lawyer Yu. Zaitsev. Previously, unscrupulous lawyers and an agent were involved in a scandal involving an attempt to obtain double agency fees from Torpedo football players.
M. Ignatov’s attempt to defend himself not in sports judicial bodies, but in a state court began encouragingly. Mytishchinsky city court satisfied the athlete’s demands – the controversial clauses of the contract were declared invalid, as well as the decisions of the RFU Committee.
However, the Moscow Regional Court overturned the decision of the first instance, citing the law on physical education and sports and the jurisdiction of these cases by the foreign CAS. But it was not taken into account that CAS had already qualified this dispute, indicating the jurisdiction of the Mytishchi city court in this case.
Apparently, according to the appeal and cassation version, guaranteed by Art. 46 of the Constitution, the right to judicial protection does not apply to athletes! Only a “private” court in a public organization is enough.
The case will soon be considered by the Supreme Court of the Russian Federation.
