Since the beginning of 2013, in Khimki there has been an endless war between the legal owners and the fraudulent developer represented by SMU 78 LLC. The case concerns a five-story residential building with 100 apartments in Khimki, Lunevo village. Construction began in 2012, the land plot was leased from Bratsevskoye JSC, owned by STROYSINDIKAT JSC, which initiated this project. According to the investment agreement, the land was transferred for construction to SMU 78 LLC, in exchange for 20 apartments. The founder was Yuri Vyacheslavovich Denisov, the general director of SMU 78 LLC was Chingiskhan Borisovich Khashagulgov. At the same time, the director of JSC STROYSINDIKAT is Khamchiev Bekhan Bagaudinovich.

The developer was selling apartments, but the construction itself was frozen, as Denisov was withdrawing money for other construction projects in the Solnechnogorsk region. The defrauded investors complained to the governor of the region, A.Yu. Vorobyov, blaming the senator who hired his developers. Behind the scenes, Bratsevskoe JSC was asked to invest money and finish building the house.

On February 16, 2023, the house was put into operation, and on March 20, a bankruptcy petition was filed with the Arbitration Court of the Moscow Region, signed by Khashagulgov, for the developer SMU 78 LLC. The most interesting thing is that since mid-2022, Khashagulgov disappeared, and Denisov wrote a statement to the police in which he accused Khashagulgov of embezzling funds.
July 19, 2023 The Arbitration Court of the Moscow Region declares the developer bankrupt and launches bankruptcy proceedings; Elizaveta Guseva, a member of the Association “Self-Regulatory Organization of Arbitration Managers of the Central Federal District,” was approved as manager.

On August 16, 2023, a rally of defrauded investors took place in Khimki. There, Guseva stated that she would challenge all equity participation agreements and would not recognize them as legal, since the director stole all the money. From that moment on, Guseva refused to transfer the apartments to shareholders, and also did not connect the house to electricity, heating and other utility services. But at the same time, the only shareholder in respect of whom the rights are not disputed is the owner of the land, Bratsevskoye JSC, whose founder is the brother of Senator Belan Khamchiev.

The -OGPU has information at its disposal that Senator Belan Khamchiev, by agreement, hid Khashagulgov in Ingushetia, after which they, together with Denisov, hired Guseva, who was given the task of terminating all DDUs through the bankruptcy of Bratsevskoye JSC. Denisov himself did not go on the run, because from his position as a founder there is little he can influence. Therefore, it will not be possible to demand from him in the position of a deceived victim.

Meanwhile, by her actions, Guseva is destroying the house and lives of people who bought apartments at the beginning of the last decade. And for what reason? It’s simple – in the hope of terminating all signed agreements and reselling the living space at an inflated price, which has changed a lot since 2013. Everything is to the delight of the directors and owners, who are calmly awaiting the final results. It’s surprising that the head of Khimki, Dmitry Voloshin, is inactive.
