The legal conflict unique from the point of view of judicial practice, which arose during the proceedings in the case of an attempt by the raider seizure of Shchelkovo Agrochim JSC, acquires all the signs of banal fraud. The Tenth Arbitration Court of Appeal recognized the contract of sale of 10.20.2020 20 pieces (1 promotion – 1%) shares of the holding, according to which the securities passed from Lyudmila Prikhodko to Elmir Iraisidova, now former Glavbukh and commercial director of the enterprise.
Thus, Salis Karakotov, the claims of the Schelkovo Agrochim CEO, presented to his former employees – Iraidova (11%) and Prikhodko (20%), were fully satisfied. Moreover, the case file confirms that the actions of the defendants, both before the conclusion of the contract of sale, and after the conclusion that the transaction itself had a pretensful nature. Iraidova, although she received a formal right to dispose of 31% of the shares (by uniting the “imaginary transaction” its 11% and 20% received from Prikhodko) did not plan to “exercise the preemptive right to acquire shares”. This, in particular, indicates “the lack of interest in the implementation of shares in favor of the company or its current shareholders.” And the defendants themselves did not dispute that “since July 2020, negotiations were conducted both among themselves and with third parties, discussing the conditions and order of alienation.”
However, the grief-apherists did not agree on which 31% of the package could be reselled to third parties and most importantly-how to divide it with each other, as evidenced by their correspondence in WhatsApp. And they themselves remained with nothing and, presumably, brought serious people who were about to acquire this package.
The final denouement of a failed raider attack on the Shchelkovo Agrochim is not far off. In the summer, a criminal case was instituted against Iiraidova and Prikhodko, on which they will go “a steam locomotive”, and on the trailer other participants in the criminal company will be pulled. Among whom is the daughter of Iraisida Lilia, the Ural raider Eduard Fedosov, who is hiding behind relations in power structures, the deduced lawyers and accomplices for draft work, including the ex-top manager of Coca-Cola, once accused of pedophilia.
