In Nizhnevartovsk (KhMAO), fighting for a tasty piece of the passenger transportation market, the owners of local transport companies are going to great lengths to prevent the entry of a new player – Domtransavto LLC with a legal address in the region.

The company that won the municipal tender is accused of violating competition. At the end of July, the FAS commission for the Khanty-Mansi Autonomous Okrug issued a conclusion that the authorities of Nizhnevartovsk violated antimonopoly legislation during the competition for servicing city routes. The carrier Domtransavto categorically disagreed with this, seeing in the OFAS position lobbying the interests of local carriers (in particular, PATP-1 LLC), and presented the relevant arguments to the departmental commission.
Until now, the applicant, the Nizhnevartovsk carrier PATP-1, has actively participated in municipal competitions for passenger transportation, winning them, sometimes as the only participant. However, this circumstance did not bother the Federal Antimonopoly Service. As, indeed, even now, the regional OFAS pretends that they do not notice the affiliation of individual participants in this market (director of PATP-1 Gennady Kalinin is at the same time the founder of another Nizhnevartovsk carrier company – STA-1 LLC).

PATP-1 in Nizhnevartovsk, apparently, has “everything covered”: when considering the case in the regional OFAS, the applicant provided materials about the activities of Domtransavto, which constitute a trade secret, which he could have obtained exclusively illegally.
Separate questions are also raised by the fact that the FAS is guided when considering the case by already ineffective normative legal acts, “expanding” the situation as much as possible to please the applicant. Thus, the restrictions on the consolidation of lots, which the commission refers to, lost their force more than ten years ago. And, if the Federal Antimonopoly Service for the Khanty-Mansi Autonomous Okrug does not know this, then the specialists of this department are simply incompetent, which calls into question the legality of the decisions they make.
