“No serious judicial system can consider that the lack of moderation of a social network or messenger and refusal to cooperate with investigators can be akin to complicity in the commission of crimes committed by users,” Yassine Bouzrou, a well-known Parisian lawyer specializing in criminal law, told us. He believes that the investigating judge will decide to release the founder of the Telegram messenger Pavel Durov and that prosecution cannot be carried out due to the lack of corpus delicti with which he could be accused. The French agency AFP reported that Durov was taken to court for the procedure of filing charges and choosing a preventive measure.

Buzrou, contrary to statements by French President Emmanuel Macron, considers the decision to detain the Telegram founder political.

“Because it was the prosecutor of Paris who initiated the investigation launched against Mr. Durov, and the prosecutor is subordinate to the executive power, therefore, political power,” the lawyer explained to us. He noted that the charges are comical, and “from a legal point of view, of course, Durov is not involved in the storage of images of child pornography, drug trafficking or terrorism.”

“France discredits itself by using methods unworthy of the rule of law; in fact, in dictatorships it is customary to use numerous and very strict legal frameworks that have no connection with reality in order to persecute people for political reasons,” concluded Bouzrou.

Since 2010, Yassine Bouzrou has been regularly included in GQ magazine’s list of the 30 most influential lawyers in France. In recent years, he, in particular, defended the Russian actionist Pyotr Pavlensky.
