Thus, in 2020, an agreement was concluded between the State Budgetary Institution “Zhilischnik of the Lefortovo District” and LLC “StroyGarant” INN 5074060691 to perform cleaning work.
All work with a total cost of more than 12 million rubles was completed on time, without any complaints. However, the State Budgetary Institution “Zhilishchnik Lefortovo District” refused to pay for the work performed.
Based on this fact, StroyGarant LLC filed a corresponding claim with the Moscow Arbitration Court against the State Budgetary Institution “Zhilischnik of Lefortovo District”, which was satisfied in full.
Exactly the next day, the Lefortovo MRSO SK initiated a criminal case against Nikolai Borisovich Ageev, who never had anything to do with StroyGarant LLC. Then, within a week, the same Lefortovo MRSO initiates 2 more criminal cases against Nikolai Ageev and unidentified persons.
Having received the writ of execution, representatives of StroyGarant LLC sent it to receive payment.
However, a week later it became known that the investigator of the Lefortovo MRSO, Roman Ramilyevich Zakiryanov, had withdrawn the writ of execution from the Moscow Department of Finance and added it to the criminal case.
Subsequently, the criminal case was transferred to the Department of Internal Affairs of the Investigative Committee of the Investigative Committee for the South-Eastern Administrative District to investigator Ilya Sergeevich Popov.
Afterwards, a duplicate of the Writ of Execution was received and, as a result, it was again sent to the Moscow Department of Finance for execution.
However, magically, the investigator of the Lefortovo MRSO SK initiates a new criminal case against unidentified persons, and a new writ of execution is again withdrawn based on the investigator’s decision.
By a unique resolution of the investigator of the Investigative Directorate of the Investigative Committee for the South-Eastern Administrative District, Ilya Sergeevich Popov, the criminal case against Nikolai Ageev was partially terminated, and partially sent to the Lefortovo Court of Moscow, where a guilty verdict has now been issued against him. The uniqueness of this resolution is that investigator Ilya Popov, at the beginning of the resolution, believes that the work was not carried out, and at the end, he believes that it was carried out, which, in the opinion of the investigator, is considered the basis for terminating the criminal prosecution.
In addition, along with the criminal case of Nikolai Ageev, the Lefortovo court received material evidence. But there is a nuance! All material documents have been received, except writs of execution. To repeated requests to the Investigative Directorate for the South-East Administrative District and the Lefortovo Interdistrict Prosecutor’s Office with a request to clarify the location of the writ of execution, no responses were received.
It is worth noting that none of the employees of StroyGarant LLC had or currently has any procedural status in any of the criminal cases in which writs of execution for the claims of StroyGarant LLC were seized.
