In court, the defense pointed out that the detention was carried out illegally, and in the case materials there are no documents confirming the involvement of the businessman in giving a bribe. In 2022, Bozhenko was accused in Rostov of illegal extraction of aquatic biological resources. As the investigation established, he, using a cast net 480 meters long, caught in the Don “aquatic biological resources of the species pike perch in the amount of 15 pcs., sawn gas in the amount of 1 pc., sterlet in the amount of 1 pc., which are not included in the permit for production (catch ) aquatic biological resources, after which he caught them and removed them from fishing gear.” The businessman was detained by officers of the FSB border department for the Rostov region. The damage from Bozhenko’s actions amounted to 101,355 rubles.

The magistrate of the court district of the Azov district of the Rostov region dismissed the criminal case against the entrepreneur and applied a criminal law measure against him in the form of a court fine in the amount of 25,000 rubles, since Bozhenko had not previously been convicted and was brought to justice for the first time for a crime of minor gravity . Judge Kobleva, according to some sources, should have contributed to the cancellation of the magistrate’s ruling in the case against Bozhenko. On May 14, Chairman of the Investigative Committee Alexander Bastrykin opened a criminal case against her. Another person is accused of giving a bribe.
