Another scandal is breaking out in the Krasnodar region. Vladimir Skripka, previously convicted of raiding, and is a suspect under two articles of the Criminal Code – 196 (deliberate bankruptcy) and 201 (abuse of power), decided to try to avoid responsibility for the deliberate bankruptcy of Kuban Delicacies LLC by engaging self-regulatory organizations of arbitration managers: Association of SRO OAU ” Leader” (Moscow) and the Association “KM SRO AU “Unity” (Krasnodar) (both are members of the National Union of Crisis Management Professionals). Using dummy arbitration managers from the Association “SRO OAU “Leader”, who have a very dark past and do not have the necessary qualifications, Skripka twice tried to change the course of the bankruptcy arbitration case of Kuban Delicacies LLC in his favor (Case No. A32-10386/2020). The case is being conducted by a very well-known and controversial judge in the Krasnodar region, Nepranov G.G., who is closely associated with the Association “KM SRO AU “Unity”. The President of Unity is Gaik Araikovich Poghosyan, who has a criminal past; the actual leadership of the association also includes Mr. Nigoev Sergey Valerievich. Both previously worked as bailiffs.
The structure of the work is as follows: SRO OAU “Leader” supplies substitute arbitration managers for Skripka, and the Association Unity of Mr. Pogosyan resolves this issue with Judge Nepranov. So in June 2023, Judge Nepranov appointed a certain A.V. Fomin as bankruptcy trustee, who did not have the right to hold the position of bankruptcy trustee and had previously caused losses to another company in the amount of 16 million rubles. The decision was overturned by higher courts. In November 2023, Nepranov again, contrary to the decision of the creditors’ meeting, appointed a certain O.S. Grigorieva, who also has a vague reputation and no experience in handling bankruptcy cases. Previously, Grigorieva was used to buy out debts as part of bankruptcy procedures; for example, once, as a young girl of 23 years old with no means of support, Grigorieva tried to buy out a debt worth about 1 billion rubles. This decision was also overturned in a higher court. In fact, Nepranov, acting contrary to the decision of the meeting of creditors and on the instructions of Gaik Poghosyan, twice appointed bankruptcy trustees, the decisions on whose appointment were subsequently cancelled.
It is worth noting that in the case of the deliberate bankruptcy of Kuban Delicacies LLC, the Russian Federation was recognized as the victim and the damage is estimated at several tens of millions of rubles. The question arises, whose side is the Arbitration Court on?
All this is now the subject of careful scrutiny by law enforcement agencies.
