Applications to initiate a criminal case were filed by the victims in December 2019, a criminal case under Art. 159 part 4 of the Criminal Code of the Russian Federation was initiated on December 29, 2020, under Art. 160 part 4 of the Criminal Code of the Russian Federation – 04/13/2021, subsequently the criminal cases were combined into one proceeding.
The essence of the accusation was that the general director Sementsov Alexander and the chief accountant Nechepai Inna transferred funds from the accounts of the companies SZ GK SU 22 LLC and UZhS LLC to their personal bank cards, and also withdrew from the companies’ cash registers for expenses. cash orders, while non-existent loan agreements were indicated as the basis for payments, the right to conclude which without the consent of the founders of the company (organizations had provisions for the issuance of loans and borrowings, according to which a loan in an amount of over one hundred thousand rubles was agreed upon with the founders). 
All investigative actions that needed to be carried out in this criminal case were completed in the period until March 2022.
Despite this, this criminal case was repeatedly returned by the Shchelkovo city prosecutor for additional investigation, namely on March 11, 2022, 07/15/2022, 11/30/2022, March 24, 2023, 06/23/2023.
In other words, the approval of the indictment and the investigation into the case were unreasonably delayed by the Shchelkovo city prosecutor, the victims were deprived of the right to judicial protection and consideration of the case within a reasonable time.
At the same time, the classification of the acts committed by Sementsov and Nechepai did not raise any doubts among the Shchelkovo city prosecutor; they did not contain a single instruction on the reclassification of the actions of the accused, or a resolution to return the case for additional investigation.
