As follows from the case materials, it could turn into a serious legal precedent. During the investigation, Mitvol’s testimony revealed that among those involved were former Minister of Transport of the Krasnoyarsk Territory Konstantin Dimitrov, ex-chairman of the government Yuri Lapshin and former head of the transport department Konstantin Mandrov. On September 8, Dimitrov, who admitted guilt and entered into a deal with the investigation, was sentenced to 3 years and 2 months in prison for “exceeding official authority” (part 3 of Article 286). Lapshin and Mandrova are charged with a similar crime, but the sentences there will be much longer.
Dimitrov was convicted for knowing about shortcomings in the materials that KrasnoyarskTISIZ submitted. Thus, when carrying out engineering and geodetic surveys, the contractor drilled 37% of the “new” wells provided for in the state contract, and for the remaining 63% of the wells used the “old” developments at its disposal (these are considered the results of drilling that was carried out more than three years ago). Although Dimitrov was well aware of this, he gave instructions to transfer money for the work performed, which constituted “excess of authority.”
In turn, Mitvol is accused of deceiving Lapshin, Dimitrov and Mandrov. Allegedly, the director of JSC KrasnoyarskTISIZ, Zharkov, in agreement with the chairman of the board of directors, Mitvol, misled officials by providing them with materials containing work completed by the institute earlier. That is, some have already been convicted in the Central District Court for “they knew, signed the acts and paid,” while others are being tried in a neighboring court for “being deceived and receiving money.”
As for the amount of damage, there are also obvious inconsistencies: Mitvol is charged with 975 million rubles – the entire amount of the government contract, although from the case materials it follows: 350 million was paid in taxes to the federal and regional budgets, 480 million went to pay for the services of subcontractors (according to one of them, FSB investigators in the Krasnoyarsk Territory have very serious questions that lead to another criminal case), and about 100 million more were the salaries of ordinary employees of the institute.
Based on the results of the investigation of the case, the main question arises – about the reasons that prompted Mitvol to enter into a deal with the investigation and admit to fraud. Perhaps this will become known at the trial, which will be held in a simplified manner, that is, without studying the case materials. And the main thing here is what crime will he ultimately be found guilty of?
Well, the criminal case itself once again proves the administrative power of Deputy Prime Minister Marat Khusnullin, who does not leave all major regional construction projects without his “attention.” It is significant that after the arrest of Mitvol and government officials of the Krasnoyarsk Territory, his wife immediately appeared in the region – the director of Mosproekt-3 JSC Anna Merkulova, who instantly received a contract for “additional design” of the metro in excess of 4.25 billion rubles (despite the fact that the regulatory period for research, approved by the Ministry of Construction, cannot be less than two years) has already handed over the materials that make it possible to build… an underground tram with a snail’s average speed of 40 km per hour.
