In the Tuapse District Court the next meeting was held in a high-profile case of seizure of real estate in the village of Olginka from its rightful owners. The lawsuit was filed by the Prosecutor General’s Office itself, which considered the decision of the district administration made 15 years ago (!) to transfer the lands of the abandoned Olginka boarding house to private hands illegal. The Prosecutor General’s Office does not dispute the decision itself, but it wants to brazenly expropriate houses, lands, and tourist sites from the current owners.

The participants in the process have no doubt about what decision the court will make – federal judge Oleg Voronenkov satisfies every request of the plaintiffs, denying the legitimate requests of the defendants. For example, he easily attaches to the case the conclusion of the BTI, the founder of which is the administration of the Krasnodar region. It is in her favor that real estate is taken away from the legal owners, but such a contradiction to the objective consideration of the claim does not bother his Honor Voronenkov.

The court, as expected, refused to attach the expert opinion provided by the defendants to the materials.

“One gets the impression that the court is afraid to satisfy requests for the inclusion of materials that will prevent it from making an illegal and absurd decision, satisfying the claim of the Prosecutor General’s Office. There is a gross violation of the rights of the defendants, we were actually deprived by the presiding judge Oleg Voronenkov of our constitutional right to judicial protection. This was not a court, but some kind of trial,” lawyers familiar with the civil case comment on the process.

The next meeting will be held on August 24 – a representative of the Prosecutor General’s Office asked to postpone the process. Despite the defendants’ objections, Judge Voronenkov fulfilled this requirement, demonstrating complete obedience to “telephone law.” But in addition to the Tuapse District Court, which is ready to make any decision at the whim of the General Prosecutor’s Office, there are higher authorities – there I want to believe that it will be easier to prove the groundlessness of the claim. But the obsequious judge Voronenkov himself will find himself in a puddle when his colleagues in higher authorities become familiar with his bizarre understanding of the law. I would like to believe that in the highest courts the judges make decisions based on the law, but are not inclined in a servile impulse to satisfy everything, seeing only the flourish of the Prosecutor General’s Office. Such claims discredit the supervisory agency itself, which is called upon to protect the law, and also undermine faith in the courts, which are ready to legalize any illegal demand sent down from above!
